Terms of service.

§1. General provisions

These terms of service (the “Terms”) set out the rules for the electronic provision of the Todrawn service (the “Service”) — interactive online whiteboards for drawing, adding shapes and images, and collaborating with other users.

The Service is provided by Jakub Kuźnicki (the “Provider”). The Provider can be contacted by email at support@todrawn.com.

Using the Service constitutes acceptance of the Terms. The Terms are made available free of charge, in a form that allows them to be downloaded, stored and printed.

§2. Definitions

  • User — a natural person holding an Account in the Service.
  • Account — the set of resources and permissions assigned to a User, available after logging in.
  • Board — a single interactive whiteboard created within an Account.
  • FREE plan — the free tier of the Service with a limited scope, described in §4.
  • PREMIUM plan — the paid tier of the Service, available as a monthly or yearly subscription or as a one-time lifetime purchase, described in §4 and §5.
  • Consumer — a User who is a consumer within the meaning of art. 22¹ of the Polish Civil Code.

§3. Registration and account

The Service may be used by persons who are at least 16 years old. Minors use the Service with the consent of a legal guardian.

Registration requires providing an email address and a password, and confirming the email address with a verification code. Until the address is verified, logging in to the Account is not possible.

Alternatively, an Account may be created by signing in with Google; in that case identity is confirmed by Google, and no separate password or email verification code is required.

The User must keep their password confidential and promptly notify the Provider of any suspected unauthorised access to the Account.

The User may stop using the Service at any time and request deletion of the Account by contacting the Provider.

§4. Scope of the service and plans

The FREE plan includes:

  • up to 3 Boards per Account,
  • up to 5 images per Board,
  • collaboration of up to 4 people on a Board,
  • the full set of drawing tools and shapes.

The PREMIUM plan includes:

  • an unlimited number of Boards and images,
  • collaboration of up to 10 people on a Board,
  • the full set of drawing tools and shapes,
  • priority support.

The Provider may develop and modify the Service’s features, provided this does not materially reduce the scope of a paid plan during an ongoing billing period.

§5. Payments and subscription

The PREMIUM plan is offered in three options, all priced in US dollars (USD): a monthly subscription at $10 per month; a yearly subscription at $75 per year (equivalent to $6.25 per month); or a one-time lifetime purchase at $120 granting permanent PREMIUM access. Payments are handled by the payment operator Stripe.

New monthly and yearly subscriptions include a one-month free trial; the free trial is limited to one per payment card. A payment method is collected when the trial begins, and the first payment is taken at the end of the trial period. The lifetime purchase is a single upfront payment and does not include a trial.

Subscriptions renew automatically for consecutive periods — monthly or yearly, according to the plan chosen — until they are cancelled. Cancellation is possible at any time and takes effect at the end of the paid billing period; until then the User retains PREMIUM access. The lifetime purchase does not renew and is not billed on a recurring basis.

If a renewal payment fails, the Provider may limit the Account to the FREE plan. Boards and images exceeding the FREE plan limits are not deleted, but new ones cannot be created above the limit.

The Provider does not store payment card data — it is processed exclusively by Stripe.

§6. Right of withdrawal

A Consumer may withdraw from the contract for the Service within 14 days of concluding it, without giving a reason, by making a statement to the Provider (e.g. by email).

PREMIUM service begins before the withdrawal period ends at the Consumer’s express request. If the Consumer withdraws within this period, they bear the cost of the services performed up to the moment of withdrawal, in proportion to the scope of the service provided.

§7. User content

The User retains all rights to the content placed on Boards (drawings, text, images).

The User grants the Provider a non-exclusive licence to store, reproduce and display the content solely to the extent necessary to provide the Service (including displaying Boards to the people the User has shared them with).

Posting content that is unlawful, infringes third-party rights or violates accepted standards is prohibited. The Provider may block access to such content upon receiving a credible report.

§8. Prohibited activities

In particular, the following are prohibited:

  • actions that disrupt the operation of the Service or place an excessive load on it,
  • attempts to gain unauthorised access to other Users’ Accounts or the Provider’s systems,
  • sharing login credentials with third parties,
  • using the Service in a way that violates the law.

In the event of a gross violation of the Terms, the Provider may suspend or delete the Account, after first calling on the User to cease the violations, unless the nature of the violation justifies immediate action.

§9. Liability and service availability

The Provider makes every effort to keep the Service running continuously and securely, and performs data backups. The Provider reserves the right to technical breaks necessary for the maintenance or development of the Service.

The Provider is liable for non-performance or improper performance of the Service on general terms. Towards Users who are not Consumers, the Provider’s liability is limited to the fees paid by the User in the preceding 12 months and does not cover lost profits.

Nothing in the Terms excludes or limits Consumer rights arising from mandatory provisions of law.

§10. Personal data

The Provider is the controller of Users’ personal data. Data is processed in order to provide the Service, handle payments and process complaints.

The User has the right to access their data, rectify it, delete it, restrict its processing, port it, object to its processing, and lodge a complaint with the President of the Polish Personal Data Protection Office (UODO). Requests may be sent to the email address given in §1.

§11. Complaints

Complaints about the Service may be submitted to the email address given in §1. A complaint should include the email address assigned to the Account and a description of the problem.

The Provider handles complaints within 14 days of receiving them and replies to the email address the complaint was sent from.

A Consumer may use out-of-court complaint and redress procedures, including the ODR platform available at ec.europa.eu/consumers/odr.

§12. Changes to the terms

The Provider may amend the Terms for important reasons, in particular changes in the law or in the scope or manner of providing the Service.

Users will be notified of changes to the Terms by email at least 14 days before they take effect. A User who does not accept the changes may terminate the contract before that date with immediate effect; for the PREMIUM plan, the unused part of the fee is refunded.

§13. Final provisions

In matters not covered by the Terms, Polish law applies — in particular the Civil Code, the Act on Providing Services by Electronic Means and the Consumer Rights Act.

The Terms are effective from 7 June 2026.
